Two kinds of unclaimed money
There is money that was never claimed, because eligible people did not file, and money that was claimed but never collected, because a check went uncashed or a digital payment was never accepted. The first kind is by far the larger. The FTC's study of consumer class action settlements found that fewer than 1 in 10 eligible consumers file a claim, which means most settlement funds pay out to a small fraction of the people they were meant for.
Where leftover funds go
Courts set the order. The Northern District of California's guidance states that unused funds allocated to fees, service awards, administration, and class payments should be distributed to the class pro rata if feasible, or else awarded to cy pres recipients or to the relevant government authorities. Cy pres recipients are typically nonprofits whose work relates to the subject of the lawsuit, and the court asks how they are connected. Reversion to the defendant is disfavored.
In practice that means a second distribution to people who filed, when the leftover is large enough to justify the cost, and a charitable award when it is not.
Uncashed checks and your state
When a settlement check is never cashed, the administrator reports it in the post-distribution accounting the court requires. Depending on the settlement and the state, uncashed amounts may be redistributed, awarded cy pres, or turned over to a state unclaimed property program. NAUPA, the association of state programs, describes unclaimed property as accounts or property with no owner activity for a set dormancy period, and lists uncashed checks among the common examples. States hold that money for the owner and let you search and claim it free of charge through their official programs.
