Aspire Health Alliance Settlement Over 2023 Breach: $400,000 Fund

Aspire Health Alliance is settling claims stemming from a targeted cyberattack on its systems in September 2023, referred to as the Data Incident. Files that may have been accessed included names, dates of birth, dates of medical service, individual health insurance policy numbers, physician or medical facility details, medical condition or treatment records, Medicare or Medicaid numbers, and patient account information.

Aspire denies any wrongdoing, and the Court has not ruled on the merits of the case. Both sides chose to settle rather than continue with the cost and uncertainty of litigation. The settlement has received preliminary approval, with a final approval hearing scheduled for October 1, 2026.

Aspire will fund the settlement with $400,000.00. Every class member automatically receives one year of medical data monitoring through CyEx Medical Shield, which includes $1 million in medical identity theft insurance. Class members can also choose between two payment options: Cash Payment A reimburses up to $2,500.00 for documented, unreimbursed out-of-pocket losses connected to the Data Incident, while Cash Payment B is an automatic, equal share of whatever funds remain, paid to those who don't file for Cash Payment A.

Documentation is only required for Cash Payment A, claimants must submit receipts or similar proof of their losses; personal statements or affidavits alone won't qualify as sufficient evidence, though they can support other documentation. Anyone who takes no action will still automatically receive Cash Payment B along with the free medical data monitoring, with no proof required.

Affected individuals should have received a notice by mail; Aspire began sending these letters on April 26, 2024. To file a claim, use the LoginID and PIN printed on that notice.
