Case overview
What is the NMPF case about?
A group of consumers has sued the National Milk Producers Federation and 13 dairy cooperatives, claiming they worked together to keep U.S. dairy prices artificially high.
The complaint focuses on a farmer-funded program called Cooperatives Working Together, now known as the NEXT Program. It alleges that competing cooperatives paid into this program to subsidize each other's overseas sales of cheese, butter, and other dairy products. According to the complaint, exporting large amounts of dairy pulled supply out of the U.S. market, which pushed up wholesale prices for cheese and butter, and because federal milk pricing formulas are tied to those products, the price of raw milk and everyday dairy rose too.
These are unproven allegations. The defendants have not yet responded in court, no judge has ruled on any of the claims, and the cooperatives are expected to argue they are protected by the Capper-Volstead Act, a law that lets farmers market their products together through cooperatives. The complaint argues that protection does not apply here.
