Case overview
What is the Jack's settlement about?
This settlement comes out of a lawsuit over a data breach at Jack's Family Restaurants. The lawsuit says that between July and August 2025, a targeted cyberattack on Jack's computer systems reached certain files containing private information. Depending on the person, those files may have held names, Social Security numbers, dates of birth, addresses, phone numbers, and bank account details used for direct deposit of wages.
Jack's denies that it did anything wrong, and the Court has not decided who is right. Both sides agreed to settle to avoid the cost, risk, and delay of a trial and to get benefits to affected people sooner.
The settlement is not final yet. The Court will hold a Final Approval Hearing on December 15, 2026, and will decide then whether to approve it. Benefits are paid out only if the Court gives final approval and after any appeals are resolved.
You may qualify if you live in the United States, your private information was involved in this data incident, and Jack's sent you a notice about it. To take part, you must submit a valid Claim Form by the deadline. Simply doing nothing means you get no benefit.
You can choose between options that require proof and options that do not. The option that requires proof is reimbursement for documented out-of-pocket losses, worth up to $4,000.00. To claim it, you must attach supporting third-party documents such as receipts. Self-prepared documents on their own are not enough, though you can use them to back up other paperwork. If you bought your own credit monitoring or identity protection because of the breach, you can also seek reimbursement for that, but you must include proof of purchase plus a short written statement.
The options that do not require proof are simpler. You can claim $20.00 per hour for time you spent dealing with the breach, up to 4 hours, for a maximum of $80.00. Or, instead of documenting losses and time, you can take a flat Alternative Cash Payment of $55.00 with no documentation needed. Everyone in the settlement can also enroll in 3 years of credit monitoring and identity theft protection at no cost, which includes $1,000,000.00 in identity theft insurance with no deductible.
Keep in mind you cannot mix the flat $55.00 payment with the documented-loss and lost-time options. You either claim reimbursement for documented losses and lost time, or you take the $55.00 flat payment, and either path can be combined with the free credit monitoring.
