Two Liberty Mutual policyholders have brought a proposed class action against Liberty Mutual Insurance Co. in Massachusetts federal court, claiming the insurer failed to secure sensitive personal information and protected health data belonging to more than 15,000 policyholders. According to the complaint, the data was compromised in a ransomware attack attributed to a group calling itself Everest, which allegedly listed Liberty Mutual on its dark web leak site, a platform where stolen records, including highly sensitive medical information, could be viewed, downloaded, or used by others for identity theft and fraud. One plaintiff says he started getting spam, scam, and phishing calls and texts after the breach, while the other alleges unauthorized charges appeared on his checking account. The lawsuit accuses Liberty Mutual of negligence, negligence per se, breach of implied contract, unjust enrichment, invasion of privacy, and violations of the Massachusetts Consumer Protection Act and the Declaratory Judgment Act.
