LiveHealth Online Users May Get Cash Over Data-Sharing Claims

A proposed class action, Polk v. American Well Corp., accuses Amwell of sharing LiveHealth Online users' medical information and private communications with outside companies without consent, allegedly through tracking, analytics, and advertising tools embedded in the LiveHealth Online website and apps. The suit claims this conduct broke the Federal Wiretap Act, the California Invasion of Privacy Act (CIPA), the California Confidentiality of Medical Information Act (CMIA), the California Constitution, and common law.

Amwell denies any wrongdoing and denies violating any law, saying it chose to settle simply to avoid the expense and risk of ongoing litigation. No court has ruled on the underlying claims.

The $2,037,751.46 settlement is still pending court approval. A Final Approval Hearing is scheduled for January 15, 2027, when the Court will decide whether the deal is fair and reasonable.

You may be eligible if you used the appointment booking feature on the LiveHealth Online website, iOS app, or Android app anytime between October 2024 and August 2025. To claim a payment, submit a Claim Form by October 30, 2026, either online or by mailing a printed copy.

No supporting documents are required. The online claim form asks for a LoginID and PIN found on the Notice sent to you by mail or email. If filing by mail, or choosing certain payment options, you'll need to provide your name, contact information, and, for electronic payment, a Venmo username or PayPal email. Every claimant must sign an attestation, under penalty of perjury, confirming they used the LiveHealth Online booking tool during the eligible period.
