Neutrogena Skin360 Users: Illinois Facial Scan Settlement

This settlement centers on Skin360, a facial-scanning skin assessment tool. Plaintiffs allege that Johnson & Johnson Consumer Inc. (now Kenvue Brands LLC) violated Illinois' Biometric Information Privacy Act (BIPA) by collecting, storing, sharing, and profiting from users' facial geometry scans through Skin360 without first providing the required written notice or obtaining written consent.

Kenvue denies any wrongdoing, disputing that it violated BIPA or that it collected, stored, shared, or profited from anyone's biometric data. No court has ruled on these claims; both sides chose to settle rather than continue litigating.

The case is currently at the preliminary approval stage: the court has granted preliminary approval and conditionally certified the settlement class. A Final Approval Hearing is scheduled, and the settlement will only become final if the court grants final approval and any appeals are resolved.

You may be eligible if you were in Illinois and completed a Skin360 skin assessment, including Neutrogena Skin360 or NeoStrata Skin360, via mobile app or website between December 9, 2019 and May 5, 2023.

Filing a standard claim doesn't require separate documentation or proof of purchase, but the Claim Form must be signed with a sworn statement, under penalty of perjury, confirming you used Skin360 in Illinois during the eligible period. If you were living outside Illinois at the time of use, the settlement administrator may request proof that you were physically present in Illinois then, and the administrator may also reasonably ask any class member for additional information.

On the claims website, you can select "I DO NOT have a Settlement Claim ID and want to complete a claim" or, if you already have one, choose "I HAVE a Settlement Claim ID."
