Case overview
What is the Progressive settlement about?
A proposed settlement addresses how Progressive handled payments to Colorado drivers whose vehicles were declared a total loss. According to the lawsuit, Progressive relied on valuation reports from Mitchell that applied a so-called Projected Sold Adjustment, which allegedly reduced what policyholders were paid below the actual cash value of their totaled vehicles, a result the plaintiffs say breached their Colorado auto policies.
Progressive denies any wrongdoing. The company says it followed Colorado law and its own policy terms, and that it is settling only to avoid the expense and uncertainty of continued litigation, without admitting fault or liability.
The settlement has preliminary approval and claims are now being accepted, but it isn't final yet. A judge must still grant final approval at a Fairness Hearing, and no money will be distributed unless that approval happens.
You may be eligible if you were insured in Colorado by Progressive Direct or Progressive Preferred, your vehicle was declared a total loss, and your payout was based on a Mitchell report that used a Projected Sold Adjustment on at least one comparable vehicle. Progressive Direct policyholders must have submitted their claim between April 12, 2019 and July 8, 2026; for Progressive Preferred, the window is December 19, 2021 to July 8, 2026.
Eligible claimants can recover 68% of their Projected Sold Adjustment Impact Amount. For Progressive Direct claims, that impact amount equals 2.75% of the vehicle's actual cash value; for Progressive Preferred claims, it's 2.25% of that value. Because this is based on each vehicle's individual value, payouts will vary by person. Altogether, the settlement makes roughly $15.24 million available, payable by check or electronic transfer, whichever you select.
Filing a basic claim typically doesn't require receipts or extra documentation, you simply confirm on the form that you're the policyholder or otherwise entitled to payment, and your name, address, and claim or policy number must match Progressive's records. If your form is unsigned or missing a claim or policy number, the settlement administrator will reach out and give you 30 days to correct it.
To submit a claim, you'll need your Claim ID (also called a Claimant ID) or Total Loss Claim Number, along with your unique PIN, both found on the postcard or email notice you should have received. If you can't locate that notice, you can contact the settlement administrator for help.
