Clark County Data Breach: Residents May Claim Up to $5,000

Clark County, Washington faces a proposed class action settlement over a data security incident that allegedly occurred around October 2023, when unauthorized third parties reportedly accessed files holding personal information belonging to current and former County residents. The exposure led several affected individuals to sue the County. Clark County denies any wrongdoing or liability but has agreed to settle the case to avoid the expense and risk of continued litigation.

The deal still needs court sign-off. A Final Fairness Hearing is set for September 30, 2026, when the Court will decide whether to approve the settlement. If approved, everyone who filed a valid, timely claim will be paid from the $800,000 fund.

Those who qualify have two payment options. The first lets you seek reimbursement for documented out-of-pocket losses tied to the breach, such as unreimbursed fraud losses, credit monitoring fees, or bank charges, up to $5,000, provided you supply supporting documentation like receipts. The second option is a pro rata cash payment: an equal share of whatever remains in the $800,000 fund, available to those without documented losses and requiring no proof.
