Case overview

What is the DraftKings, Inc. case about?

An investigation is underway into claims that DraftKings Inc. built DraftKings Sportsbook and its mobile apps to be addictive. Named features include live in-game microbetting (frequent small wagers on individual plays as a game unfolds), unpredictable reward patterns, personalized push notifications, bonus offers, VIP host outreach, and algorithmic targeting of users. The claims further allege DraftKings failed to block minors from the platform, failed to safeguard vulnerable young adults under 25, and relied on marketing like "risk-free" bet offers and social media ads that reached underage audiences. These remain unproven allegations.

Two groups are being evaluated. The Adult Diagnosis Track covers anyone, regardless of current age, who began using DraftKings Sportsbook before turning 25 and has since been diagnosed with a gambling addiction or disorder. The Minor Use Track covers anyone who used the platform before turning 18 - including parents of a minor who did - and does not require a diagnosis or a minimum financial loss. Using only DraftKings Fantasy, Pick6, Casino, or Horse Racing doesn't qualify on its own.

These are individual personal injury claims, often grouped as a "mass tort," pursued through individual arbitration or court rather than as a class action. Each claimant must prove their own injuries and damages, with claims grounded in product liability, consumer protection, and negligence law.

The firm is currently signing up clients and reviewing claims, though no arbitration filed through this effort has yet been verified. Separately, other plaintiffs have already sued DraftKings over alleged addictive design, misleading promotions, and VIP host conduct - including a September 2026 complaint claiming DraftKings used artificial intelligence to target vulnerable bettors. Signing with the firm doesn't mean a claim has been filed; notifying DraftKings and formally filing an arbitration demand or lawsuit happen later, as separate steps.

If a claim succeeds, potential relief could include compensation for gambling losses, treatment and medical expenses, lost income, and pain and suffering, with punitive damages - extra money meant to punish particularly harmful conduct - possible in some cases. None of this has been awarded or approved yet.

Those who believe they qualify can request a free case evaluation. Submitting information doesn't guarantee representation, claim acceptance, or any payout. You may need to sign medical records releases, complete questionnaires, and supply records of your betting history. DraftKings could, in theory, restrict account access for those pursuing a claim, though this is considered unlikely. Legal fees are taken as a percentage of any recovery, so there's no cost unless you win money.
