Six plaintiffs from New Jersey, Illinois, New York, and Massachusetts have filed a lawsuit against Driscoll's, alleging the company sold conventional strawberries containing residues of eight fluorinated pesticides, referred to in the complaint as "PFAS-Laden Pesticides", while advertising them with language like "Only the Finest Berries" and "naturally grown." The lawsuit does not allege that anyone was actually harmed or that any U.S. legal pesticide limit was exceeded. Instead, the plaintiffs' theory is that they paid a premium price for the berries that they wouldn't have paid had they known about the pesticide residues.
