Case overview
What is the McDonald's case about?
Ordering a drink labeled "Sugar Free" seems like a safe bet if you're avoiding sugar, but a new class action lawsuit argues that label is misleading for certain McCafé beverages, and that McDonald's knew customers would take it at face value.
Four drinks are named in the suit: the Sugar Free Vanilla Latte, the Iced Sugar Free Vanilla Latte, the Sugar Free Vanilla Cappuccino, and the Iced Sugar Free Vanilla Coffee. While the flavored syrup used in these drinks may genuinely be free of added sugar, all four are made with whole milk, which naturally contains lactose, a sugar that federal food labeling rules count as sugar content.
According to the lawsuit, McDonald's own nutrition disclosures show these drinks contain somewhere between about 1 and 18 grams of sugar per serving, depending on which drink and size is ordered. A large Sugar Free Vanilla Latte is alleged to carry a full 18 grams. That matters because federal regulations generally only allow a "sugar free" claim when a product has less than 0.5 grams of sugar per serving. The suit also claims these drinks are missing a required disclosure clarifying they're "not a low calorie food," despite ranging from roughly 90 to 280 calories.
The complaint further alleges that sugar content is absent from in-store menu boards and signage, and that the nutrition screens on self-order kiosks show calorie counts but omit sugar grams entirely. It contends that most customers don't realize plain milk naturally contains sugar, meaning simply listing "whole milk" as an ingredient doesn't undo the impression created by the "Sugar Free" name. The plaintiff says they paid about $4 for an Iced Sugar Free Vanilla Latte in September 2026 and claims they either wouldn't have bought it, or would have paid less, had they known it contained sugar.
The lawsuit seeks to cover anyone in the U.S. who purchased these drinks for personal, family, or household use within the applicable legal time period, plus narrower subclasses in specific states. It raises claims under New York consumer protection law, the consumer protection laws of other states, and unjust enrichment. The plaintiff is seeking actual damages, price premium damages, statutory damages, treble damages for willful violations, restitution, and attorneys' fees. At this stage, these remain allegations only, and McDonald's has not been found to have violated any law.
