What this settlement was about
This class action claimed that Walmart at times mislabeled sold-by-weight "weighted goods", beef, pork, poultry, fish, and similar unit-priced products, when it reduced their prices as they neared expiration. The final sale price allegedly did not accurately reflect the unit price, so customers paying for reduced-price perishables were overcharged.
The claims were brought under the Florida Deceptive and Unfair Trade Practices Act and for unjust enrichment. Walmart denied all allegations but agreed to a claims-made settlement with a $4.5 million floor and a $9.5 million ceiling.
171,151 claims were filed, with only two objections, one later withdrawn, and a single opt-out that was deemed invalid. Because claims did not exhaust the fund floor, lower-tier payments were increased pro rata, so claimants could receive more than the nominal caps.
